1. Introduction
This Privacy Policy describes how NextDev, Inc. (“Nextdev,” “we,” “us,” or “our”) collects, uses, discloses, and safeguards information in connection with its services. Nextdev operates two related lines of business: (a) an AI-native engineer recruiting service through which we present pre-vetted software engineers to prospective employers (the “Recruiting Service”); and (b) the Agent Usability Index, a public benchmark and leaderboard measuring how effectively AI coding agents can use third-party developer APIs (the “Index”). The Recruiting Service and the Index are referred to collectively as the “Services.” By accessing the Services, you acknowledge that you have read and understood this Policy.
2. Information we collect
Candidate information (Recruiting Service)
- Identity and contact details you provide, such as your name, email address, and location.
- Professional information, including your résumé or CV, employment and education history, and links to public profiles (e.g., LinkedIn, GitHub).
- Results and artifacts from AI-assisted coding assessments you elect to complete, including submitted code, prompts, and evaluation scores.
Client information (Recruiting Service)
- Business contact details for representatives of companies engaging us to hire, such as name, work email, and company name.
- Hiring requirements, role specifications, and other information you submit through our intake forms or in correspondence.
Index information
- Publicly available information about the API vendors we benchmark (website, documentation, SDKs, and published materials).
- Telemetry generated by our benchmark harness — agent prompts, tool calls, run duration, and per-assertion pass/fail outcomes. This is research data about the AI models we evaluate; it is not personal information about you.
- Correspondence from vendors who submit corrections, disputes, or benchmarking requests.
Information collected automatically
- Standard server logs (IP address, timestamps, requested URLs, and user-agent), used for security and abuse prevention.
- Privacy-conscious, first-party analytics (such as page views and country-level location). We do not employ cross-site tracking, advertising trackers, or device fingerprinting.
3. How we use information
- To operate the Recruiting Service — sourcing, vetting, and presenting candidates to prospective employers and facilitating placements.
- To operate and publish the Index, including the leaderboard, methodology, and per-vendor pages.
- To communicate with you, respond to inquiries, and process disputes or correction requests.
- To maintain, improve, and secure the Services and to detect and prevent fraud or abuse.
- To comply with legal obligations and enforce our agreements.
4. How we share information
- Candidate profiles, résumés, and assessment results are shared with prospective employer clients as an inherent part of the Recruiting Service, undertaken with the candidate's participation.
- Client information is used and shared only as necessary to fulfill a placement engagement.
- Index scores, grades, and methodology are public by design; aggregate harness telemetry may be released as open research data after personally identifying information is removed.
- We share information with service providers that operate the Services (e.g., hosting, email, analytics, and AI model providers) solely to the extent necessary to provide the Services.
- We do not sell personal information, and we do not share it with advertising networks.
- We may disclose information where required by law or where reasonably necessary to protect the rights, property, or safety of Nextdev, our users, or the public.
5. Cookies and similar technologies
We use cookies for authentication on account and administrative tooling and for first-party analytics. We do not use third-party advertising cookies or trackers. Most browsers allow you to refuse or delete cookies; doing so may affect certain features of the Services.
6. Third-party services
The Services rely on third parties to function, including cloud hosting, email providers, first-party analytics, frontier AI model providers, vendor sandbox APIs, and source-control platforms. Each third party maintains its own privacy practices. We do not transmit candidate or client personal information into vendor or AI-model APIs used to operate the Index.
7. Data security
We employ industry-standard safeguards, including encryption in transit (HTTPS), access controls limiting who may view production data, and logging of administrative activity. No method of transmission or storage is completely secure; in the event of a data breach affecting your information, we will provide notice as required by applicable law.
8. Data retention
We retain information for as long as necessary to provide the Services and for legitimate business or legal purposes. Candidate and client information is retained for the duration of our relationship and thereafter as required for record-keeping, and is deleted upon a verified request unless we are required to retain it. Public Index data persists as part of the historical record. Server logs are retained for up to 90 days.
9. Your rights and choices
Depending on your jurisdiction, you may have the right to access, correct, delete, or restrict the processing of your personal information, and to request a copy of it. Residents of the European Economic Area and the United Kingdom have rights under the GDPR; residents of California have rights under the CCPA/CPRA. To exercise any right, contact us at

10. International data transfers
Nextdev is based in the United States, and the Services are operated there. If you access the Services from outside the United States, you understand that your information will be processed in the United States, where data-protection laws may differ from those of your jurisdiction.
11. Children's privacy
The Services are not directed to children under the age of 18, and we do not knowingly collect personal information from them. If we learn that we have collected such information, we will delete it.
12. Changes to this Policy
We may update this Policy from time to time. When we make material changes, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Services after an update constitutes acceptance of the revised Policy.
