1. Acceptance
By accessing the Agentic Readiness Index at joinnextdev.com/labs, reading the methodology, downloading the harness, or contacting us about a benchmark, you agree to these Terms. If you do not agree, do not use the Index.
2. What Nextdev Labs is
Nextdev Labs is an independent research effort that benchmarks how well AI coding agents can use third-party developer APIs. The Index publishes per-vendor scores, grades, methodology, and the open-source harness used to produce them.
3. Use of the Index
- You may view, link to, cite, and quote the Index for any purpose, including commercial use, provided attribution is given.
- You may not republish the Index in a way that materially alters scores, grades, or methodology without clearly noting your modifications.
- You may not present derived scores under the Nextdev Labs name or imply endorsement we have not given.
- You may not access the site or harness in a way designed to disrupt operation (rate-limit abuse, scraping at volume).
4. Methodology and reproducibility
All benchmarks are designed to be reproducible. The grader, harness, and reference solutions are open source. If you reproduce our results and get materially different numbers, contact us — we treat that as a methodology bug, not a dispute.
5. Vendor representation
- We measure publicly available developer APIs. Vendors are not required to opt in.
- Vendors may submit corrections, dispute findings, or request priority benchmarking. Disputes are reviewed and either applied (with a published changelog) or declined (with a public explanation).
- We do not accept payment to alter a score, suppress a finding, or change a grade. Sponsored prioritization of which APIs we benchmark next is acceptable and will be disclosed.
6. Benchmark submissions
If you submit benchmarks, reference solutions, failure modes, or methodology improvements to Nextdev Labs (by PR, email, or otherwise), you grant Nextdev a perpetual, worldwide, royalty-free license to use, modify, publish, and incorporate that material into the Index and harness. You confirm you have the rights to grant this license.
7. Open-source harness
The harness at
github.com/nextdev-extension is published under its repository's LICENSE file. Refer to that license, not these Terms, for how you may use the harness code itself.
8. Intellectual property
All content on the Index — page copy, layout, brand, methodology prose, score displays — is owned by Nextdev, Inc. except where indicated. Vendor names, logos, and trademarks belong to their respective owners and are used here for the limited purpose of identifying the entity being benchmarked.
9. No professional advice
The Index is research output, not professional advice. Scores reflect agent performance on a defined task set at a defined moment in time. You are responsible for your own integration decisions; do not treat a score as a recommendation, endorsement, or fitness guarantee for any vendor.
10. Disclaimers
The Index is provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Index is error-free, that scores will not change, or that the harness will run successfully in any given environment.
11. Limitation of liability
To the maximum extent permitted by law, Nextdev, Inc. and its officers, employees, and affiliates are not liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of the Index, including loss of profits, data, or business — even if advised of the possibility of such damages. Our total liability for any direct damages is capped at USD 100 or the amount you paid us in the prior twelve months, whichever is greater.
12. Indemnification
You agree to defend and indemnify Nextdev against claims arising from your misuse of the Index, your violation of these Terms, or your infringement of any rights of a third party.
13. Modifications
We may update these Terms at any time. Material changes will be announced on the site or via email. Continued use after a change constitutes acceptance.
14. Termination
We may suspend or terminate your access to the Index for breach of these Terms or to protect the integrity of the service.
15. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Delaware.
